Anothersuit seeking Buhari’s disqualification filedin Abuja court

A third in the series of suits seeking to disqualify the presidential candidate of the All ProgressivesCongress (APC), Maj-Gen. Muhammadu Buhari, in this month’s election has been filed at theFederal High Court in Abuja.
The suit which was filed on Wednesday by Dr. AyakemeWhiskey is seeking a courtorder that would declarethe former Head of State ineligible tocontest the February 14 presidential poll.
Aside this disqualification suit, a direct criminal complaint has been pending against Buhari beforean Abuja Magistrate Court which is requesting the Court to directthat the APC flag bearer “be broughtto book” for allegedly claiming on oaththat he had a certificatehe did not obtain.
Justice Adeniyi Ademola of the Federal High Court in Abuja has already picked February 9 as date for hearing in the two previous suits. The judge had on Monday and Tuesday ordered that the processesbe served on Buhari throughpublication in national dailies.
INEC and Buhari are the two defendantsin suit with the code number FHC/ABJ/CS68/2015.

Whiskey towed the pathof the plaintiffs in the two previous suits, by anchoring his caseon similar grounds of alleged failure of Buhari to accompany his Form CF001 submittedto INEC with his certificatesof academic qualifications.
He contendedthat failure of Buhari to do so had rendered him ineligible toparticipate in thepoll as he failed to complywith provisions ofsections 131 and 318 of the 1999 Constitution and section 31(3) of the Electoral Act, 2010.
In an affidavit he personally deposed today, he averredto wit: “That the documentssubmitted tothe 2nd defendant did not show evidence of schoolcertificate, whetherfirst or secondary.
“Thatby not providing and attaching his certificatesas required, the2nd defendant has leftthe question of his qualification for the electionto conjecture.
“Thereis no way toknow whetheror not the 2nd defendant has the requisite educational qualification necessaryto contestfor the position ofPresident of theFederal Republic of Nigeria.”
A certainMax Ozoaka filed the suit that was markedFHC/ABJ/CS/14/2015 while theother that was coded FHC/ABJ/CS/01/2015 was filed by Chukwunweike Okafor.

The fresh suit instituted by Whiskey has not been assignedto a judge neitherhas a date been fixed for its hearing as at press time.
